These Terms govern your access to and use of the Duska mobile application (the “App”) and related services (the “Service”),
provided by Duska Team (“Duska”, “we”, “us”, or “our”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
Duska is an AI-powered chat companion that generates suggested replies based on information you choose to provide, including chat screenshots and details about your conversational partner.
AI output notice: outputs are generated automatically and may be inaccurate, incomplete, or inappropriate in some contexts. You are responsible for how you use outputs and for verifying them as appropriate.
3) Account registration and security
- Provide accurate, current information and keep it updated.
- Maintain the confidentiality of your credentials.
- Notify us promptly of suspected unauthorized access.
You are responsible for all activity under your account.
4) Your content and permissions
User Content includes any text, images, chat screenshots, and other materials you upload, submit, or provide through the Service.
- Ownership: you retain ownership of your User Content as between you and Duska Team.
- License: you grant Duska Team a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and use User Content solely to provide, maintain, and improve the Service (including generating requested outputs and troubleshooting), subject to our privacy practices.
- AI processing & deletion: uploads used for generation are processed on Duska Team’s own servers and are deleted immediately after processing (or as soon as reasonably practicable for short-lived technical handling).
- No biometrics: we do not perform facial recognition or biometric identification.
- No training/marketing use: uploads are not used to train models or for marketing.
- Your control: you choose whether to upload and whether to generate content.
5) Acceptable use
You agree not to use the Service to do anything illegal or harmful. For example, you must not:
- Upload content you do not have the right to share (including others’ private communications without permission).
- Infringe intellectual property, privacy, or other rights.
- Harass, threaten, or harm others.
- Reverse engineer, interfere with, or disrupt the Service.
- Bypass security or access controls.
We may restrict access or suspend accounts if necessary to protect the Service or others.
6) Third-party content and services
The Service may rely on content you provide originating from third-party platforms (e.g., chat screenshots). Third parties may have their own terms and policies, and your use of them is at your own risk.
7) Fees and purchases (if offered)
The App may offer optional paid features. If you make a purchase, you agree to the pricing and payment terms presented at the time of purchase. Purchases through Apple’s in-app purchase system are processed by Apple and subject to Apple’s terms.
8) Privacy
Our collection and use of personal information are described in our Privacy Policy (provided separately). By using the Service, you acknowledge that you have reviewed it.
9) Intellectual property
The Service, including software, design, and trademarks, is owned by Duska Team or its licensors and is protected by applicable laws. Except for the limited rights expressly granted to you, no rights are transferred.
10) Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11) Limitation of liability
To the maximum extent permitted by law, Duska Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses.
In all cases, Duska Team’s total liability will not exceed the greater of (a) the amount you paid to Duska Team for the Service in the 12 months before the event giving rise to the claim or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
You agree to indemnify and hold harmless Duska Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
13) Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service, users, or our rights. Provisions that should survive will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
14) Governing law; dispute resolution; binding arbitration
Governing law: These Terms are governed by the laws of the jurisdiction where Duska Team is primarily established, without regard to conflict of law principles.
Binding arbitration: Except where prohibited by law, disputes arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration rather than in court, by a neutral arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
Where required by law, you may have rights to bring certain claims in small claims court or to opt out as applicable.
15) Changes to these Terms
We may update these Terms from time to time. The Effective Date above indicates when the latest version took effect. We will provide notice of material changes as required by law.
